RENTAL AGREEMENT 406 Lake Davenport Boulevard, Davenport Lakes, Florida 33897 Owners Nicola & Antony Hopson 01708 701340
This rental agreement is made on the 14th day of November 2004 between Nicola & Antony Hopson (owners) and …………….. (as Renters) of …………………………………… 1. The owners agree to rent to the renter(s) the premises located at 406 Lake Davenport Boulevard, Davenport Lakes, Florida 33897 for the term of ___ nights. Check-in on _____________ and check-out on ___________________________________. The renter(s) agree to pay the sum of ______- and a security/damage deposit of ________ 25% of the total payment is due upon booking with the balance due 4 weeks prior to departure unless otherwise agreed with the owners. If the booking is made within 4 weeks of departure payment is due in full at the time of the booking. The security deposit will be returned upon a satisfactory inspection by our management company, which would normally be within a week of departure. 2. Pets, and smoking inside the property is not permitted at any time. Smoking is allowed in the pool area away from the lanai connecting the pool area with the villa. 3. The premises shall be used for residential purposes only and renter(s) shall peacefully and quietly occupy same and shall not interfere with the rights of other renters or neighbours. Renter(s) shall permit no activities on the premises, which are contrary to any law, ordinance and/or any applicable health and/or fire department or insurance policy provisions. The renter(s) shall not park or drive vehicles on the lawn or in an area that will obstruct any adjoining drive. 4. The renter(s) shall leave said premises in a clean and sanitary condition upon exit. 5. Cancellation Policy: Cancellation at short notice means that the accommodation cannot be let to other guests but on-going costs still need to be met. The owner reserves the right to levy the following cancellation charges:
However, the owner will always endeavour to rebook the accommodation if you are unable to go on your holiday. At short notice this may mean offering the accommodation to guests at less than the set tariff. Provided the accommodation can be re-let any amount paid by the customer will be returned less any costs in rebooking and any difference in the tariff paid by the new customer. No refund will be made if booking is cancelled after taking occupancy. 6. The renter(s) should report promptly to the owner or management company any mechanical, electrical, plumbing or other problems with the premises

The owner and/or the management company of the said premises is not responsible for injury to renter(s), their family or guests, or to damage to their personal property incurred during their stay. Renter(s), their family and guests bear the risk of any injury. 8. The renter(s) must ensure that their party must take adequate travel insurance and it is strongly recommended that this is taken at the time of booking. 9. The renter(s) must be over the age of 18. 11. This agreement will be governed by English law. 12.No liability can be accepted by the Owner where the contract is affected by 'force majeure'. In the context of these terms and conditions, 'force majeure' is any event that the Owner or the property management company could not, even with due care, foresee or avoid. These events include but are not limited to war, threat of war, riot, civil commotion or strife, hostilities, industrial dispute, natural disaster, fire, acts of God, terrorist activity, nuclear disaster, adverse weather, government action, technical problems with transportation or other events outside the Owners or the property management companies control. The Owner and/or the property management company do not accept any responsibility or liability for acts of omission of third parties which may prevent or disrupt a client's booking. The booking contract exists between the owners and the client and is limited to the rental of the property and associated services only. The information and descriptions supplied here are believed to be accurate and offered in good faith. Certain features or facilities may not be available from time to time due to circumstances beyond our control for which the Owner and/or the property management company accepts no liability. In addition no liability can be accepted by the Owner and/or the property management company for any injury, loss or damage to the Customer, any member of the Customers Party or any visitor to the rental home, arising out of or in connection with the use of the rental home or the pool.
13. The Customer must ensure that all Children are supervised at all
times whilst in or around the pool.
14. If a catastrophe (hurricane, tornado, earthquake, flood etc.) impairs the villa the owner is not responsible for finding alternative accommodation or for any financial losses related to transportation or alternative lodging. If, on the day that the rental is scheduled to begin, the property in uninhabitable, or the property cannot be reached by the usual means of transporation, or access to the property has been prohibited by the authorities then the owner will refund all money paid by the renter for the vacation rental. (renters) If renters are required by local authorities to evacuate the area, and actually do so before their stay is complete then the owner will refund a pro-rata portion of the unused rent paid. The
above provisions protect renters to a higher degree than U.S. law.
Whilst the owner cannot be responsible for locating alternative
accommodation we would make an effort to do so. Tigger-Woods
Florida Villa is part of a community and as such will have others staying
in accommodation close by. Often these will be families with young
children. We ask you to respect your neighbours at all times by acting in
a responsible manner. If you wish to party details of the great local
nightlife can be found on the local attractions pages of our web site, the
internet and local booklets.
We sincerely
hope that you enjoy our villa and your stay in Florida. If you are unhappy
with anything please let us know so that we can investigate and try to
ensure future guests have the best possible vacation.
You should
bring any problems to the attention of the management company immediately
and advise the owner in writing within 14 days of your departure date. If
you do not report the issue within this criteria the owner cannot accept
